SB 297 (Romero)— Taxation: alcoholic beverages.

Status: SEN GO. Hearing canceled at the request of author.

Summary: This bill would authorize the board of supervisors of a county, subject to certain conditions that include voter approval, to levy on a countywide basis, for revenue purposes only, a tax on the privilege of consuming beer, wine, and distilled spirits, as defined, purchased in an on-sale licensed premises, at a rate of at least 1/8 of 1%, but not to exceed 5%, of the sale price, as provided.  The bill would require the board of supervisors of a county either to notify the State Board of Equalization that the county will administer its tax on its own behalf or that it will contract with the State Board of Equalization to administer the tax, as provided.


AB 960 (Hancock)— Alcoholic beverages: licensing restrictions.

Status: Made into 2-yr bill in ASM GO, ABC required to report on its enforcement activity at a public hearing in November, as it relates to the need for this bill.

Update: As of 3/16/07, we were notified by author’s office that the bill would be amended to address the license transfer process..

Update: As of 3/19/07, the bill amendments being considered will allow transfer of off-sale licenses from specified over concentrated census tracts in Oakland and Richmond, with reduced inter-county transfer fee (from $6000 too $100), to other counties who want additional on-sale licenses. The off-sale turns into an on-sale in the process.

Update: Because the bill’s sponsors were unhappy with amending the bill, the author agreed to put forth the original language at the ASM GO hearing on 4/25/07. They put together a good case, and I’m hopeful Cal Council will take a SUPPORT position now on the bill, since it is a 2 year bill.

Summary: This bill would authorize a county or city to provide for a reasonable amortization period and termination of, or imposition of conditions on legal nonconforming uses pursuant to, a validly enacted zoning ordinance. These provisions would apply to premises that had been used in the exercise of rights and privileges conferred by the retail license at a time prior to the effective date of the zoning ordinance that are located in areas of undue concentration, as defined.

Summary:; This bill (originally a spot bill) increases penalties, primarily on people under the age of 21, for using false id or furnishing to another underage person, for purchasing or consuming alcohol in an on-sale license, for possession in public, etc. There are many provisions.
