AB 345 (Saldana) — The Underage Drinking Prevention Act of 2007.

Status: Made into 2 yr bill in ASM GO, so no action until Jan 08

Update: Amended on February 14 to be just an intent bill (so it does not require a 2/3 vote), so it would only require that the BOE yearly calculate the total amount of revenue collected from the reclassification of alcopops and report it to the legislature. Then it would recommend how that money be spent, but not require it to be spent that way.

Summary: This bill would establish the Underage Drinking Prevention Act of 2007, and would impose a surcharge in varying amounts on the existing fees paid by specified licensees, and make a continuous appropriation of these amounts to the Department of Alcoholic Beverage Control and the State Department of Alcohol and Drug Programs for the prevention of underage drinking.     This bill would also require ADP to report to the Legislature yearly on the impact of alcohol marketing on youth and on specified topics regarding alcoholic beverages with special appeal to minors.     This bill would result in a change in state taxes for the purpose of increasing state revenues within the meaning of Section 3 of Article XIII A of the California Constitution, and thus would require for passage the approval of 2/3 of the membership of each house of the Legislature.  This bill would take effect immediately as an urgency statute.


AB 346 (Beall and Saldana)— The Prevention of Youth Access to Alcoholic Beverages with Special Appeal to Minors Act of 2007.

Status: Passed ASM GO, must go to ASM APPROPS

Update: The bill was amended 2/14/07 and narrowed to address only Alcoholic beverages: labels.
Update: It was further amended in ASM GO  on 4/26/07 to address only beer products and exempt wine and distilled spirits products. The language was written with strong input from the attorneys from the Public Law Group so as not to undermine the Santa Clara Co law suit against the BOE or the rulemaking process from the youth initiative.

Summary: This bill would establish the Prevention of Youth Access to Alcoholic Beverages with Special Appeal to Minors Act of 2007, to prevent underage drinking of, and access to, alcoholic beverages with special appeal to minors, as defined.

AB 413 (Ruskin)—Alcoholic Beverages: Licenses.

Status: ASM GO, hearing canceled at request of author

Summary: This bill would expand the notification requirement for a new license to include instances of a change in ownership of the retail license. The bill would also require the applicant to mail notifications to residents and owners of real property via certified mail.


AB 951 (Jones and Nakanishi)— Alcoholic beverages: possession: Lower American River.

Status: Passed ASM GO, passed ASM APPROPS,

Summary: AB 951, as introduced, Jones. Alcoholic beverages: possession: Lower American River. This bill would prohibit a person, in a nonmotorized vessel on certain portions of the Lower American River, as defined, from possessing a container of alcoholic during the summer holiday periods that the Sacramento County Board of Supervisors prohibits the consumption or possession of an open alcoholic beverage container on the land portions along the river. This bill would declare that it is to take effect immediately as an urgency statute.


SB 450 (Oropeza)— Alcoholic beverages: licensees: local government review.

Status: Failed passage in SEN GO, but granted reconsideration.

Summary: This bill would authorize the department to extend the 30-day period for an additional 20 days if a proper written request is made by any entity or official receiving the required notification, not just law enforcement. This bill would also require a licensee to display a sign stating the contact information for local law enforcement and the department's district office, for purposes of reporting potential violations by the licensee, as provided.
